Gardeners St. John’s Wood Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners St. John’s Wood provides gardening and related services to residential and commercial customers within our service area. By making a booking or allowing us to commence work, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you should not book our services or should cancel any existing booking in accordance with the cancellation provisions below.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Client means the person, firm or company booking the services of Gardeners St. John’s Wood.

1.2 Services means any gardening, garden maintenance, garden clearance, lawn care, hedge trimming, planting, pressure washing, seasonal tidy-ups or related work that Gardeners St. John’s Wood agrees to provide.

1.3 Agreement means the contract between the Client and Gardeners St. John’s Wood comprising these Terms and Conditions and any written quotation, work order or booking confirmation issued to the Client.

1.4 Service Area means the main operating area of Gardeners St. John’s Wood and surrounding neighbourhoods, as communicated at the time of booking.

2. Booking Process

2.1 Bookings may be requested via our online contact form or by other written or verbal means as we may make available from time to time. All bookings are subject to acceptance by Gardeners St. John’s Wood.

2.2 When you request a booking, we may provide a provisional estimate based on the information you supply, such as garden size, condition, access, and the nature of the requested work. Any estimate is not binding until confirmed following our assessment.

2.3 For certain jobs, especially larger or more complex projects, we may need to visit the property to assess the site before confirming the work, price and timeframe. The visit may be free of charge or subject to a call-out fee, which will be explained in advance.

2.4 A booking is only confirmed when you receive explicit confirmation from Gardeners St. John’s Wood, which may be written or verbal. We reserve the right to decline any booking at our sole discretion.

2.5 You are responsible for ensuring that all information you provide in relation to the booking is accurate, including property access details, parking availability, and any relevant restrictions or special requirements.

3. Scope of Services

3.1 The Services we will supply are those described in the quotation, work order or booking confirmation. Any additional work requested on the day of service may be subject to further charges and may not be completed during the same visit.

3.2 Gardeners St. John’s Wood will perform the Services with reasonable care and skill, using appropriately trained personnel and suitable equipment.

3.3 Unless specifically agreed in writing, our Services do not include structural building works, major tree surgery, electrical or plumbing work, pest control, or any tasks that require specialist licensing or certification outside the scope of regular gardening and grounds maintenance.

3.4 All timings and dates for providing the Services are estimates and subject to weather, access, and operational considerations. While we make reasonable efforts to meet agreed dates and times, these are not guaranteed and we shall not be liable for minor delays or rescheduling.

4. Client Obligations and Access

4.1 The Client must ensure that Gardeners St. John’s Wood personnel have safe and unobstructed access to the garden and any necessary facilities (such as water supply and external power, where applicable) for the duration of the visit.

4.2 The Client is responsible for providing accurate instructions as to boundaries, areas of the garden to be worked on, and any plants, features or areas that must not be disturbed. We are not liable for loss or damage arising where boundaries or no-go areas were not clearly indicated.

4.3 The Client must inform us in advance of any known hazards, such as unstable structures, hidden ponds, sharp objects, or subterranean services that could be affected by our work.

4.4 If we are unable to access the property or carry out the work on arrival due to issues within the Client’s control, including but not limited to locked gates, lack of parking where previously agreed, or hazardous conditions, we may charge a call-out or cancellation fee as set out in these terms.

5. Prices and Payment Terms

5.1 Prices for Services are as quoted to the Client and confirmed at the time of booking. Prices may be on an hourly rate, a fixed price for a specific job, or a regular maintenance fee, as agreed.

5.2 Unless stated otherwise, all prices are expressed in pounds sterling and include any applicable taxes that we are required to charge.

5.3 We reserve the right to revise our prices from time to time. Any revised pricing will not affect confirmed bookings already accepted, except where the scope of the work has changed or conditions differ materially from those described by the Client.

5.4 For one-off jobs, payment is typically due on completion of the work, unless a deposit or advance payment has been agreed. For larger projects or ongoing maintenance contracts, we may require a deposit, staged payments, or payment in advance for a specified period.

5.5 Payment methods accepted will be confirmed at the time of booking. We do not accept payment in cash left unattended at the property.

5.6 If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate and to suspend further services until all outstanding sums are paid in full.

6. Cancellations and Rescheduling

6.1 The Client may cancel or reschedule a booking by giving us notice. For standard visits, we request at least 24 hours’ notice. For larger or full-day jobs, we may require a longer notice period, which will be communicated in advance.

6.2 If you cancel or reschedule with less than the required notice, we reserve the right to charge a cancellation fee which may include reasonable costs incurred and the time allocated to your booking.

6.3 If we are unable to provide the Services on the agreed date and time due to adverse weather, staff illness, equipment failure, or other circumstances beyond our reasonable control, we will notify you as soon as practicable and offer an alternative date. We shall not be liable for any loss arising from such rescheduling.

6.4 Gardeners St. John’s Wood may cancel the Agreement at any time with immediate effect by giving written or verbal notice if the Client is in material breach of these Terms and Conditions, fails to provide safe access, or behaves in an abusive or threatening manner towards our staff.

7. Gardening Work, Materials and Plants

7.1 Where we supply materials, plants, turf, soil or other goods as part of the Services, we will use items of reasonable quality suitable for the intended purpose.

7.2 Living plants, turf and similar items are subject to natural variation and their performance depends on factors beyond our control, including weather, soil conditions, pests and subsequent care by the Client. While we take care in selection and planting, we do not guarantee survival, growth rate or final appearance unless expressly stated in writing.

7.3 Any specific plant varieties or materials requested by the Client are subject to availability. If an item is unavailable, we may propose a suitable alternative of similar value and characteristics, to be agreed with the Client before proceeding.

7.4 The Client is responsible for ongoing watering, feeding and maintenance of the garden and plants after our visit, unless an ongoing maintenance arrangement has been agreed.

8. Garden Waste and Environmental Regulations

8.1 As part of our gardening services, we may generate green waste, such as grass clippings, prunings and leaves. Our default approach is to place green waste in the Client’s garden waste bins or composting area, if available and suitable.

8.2 If the Client requests removal of green waste from the property, this may incur an additional charge to cover transport and disposal, in accordance with applicable waste regulations.

8.3 Gardeners St. John’s Wood complies with relevant waste and environmental regulations when handling and disposing of waste materials. We do not remove or dispose of hazardous waste, including but not limited to asbestos, chemicals, paint, oils or contaminated soil.

8.4 The Client must inform us if any waste on site is suspected to be hazardous. We reserve the right to refuse to handle or move any material we reasonably believe may be unsafe or in breach of regulations.

9. Damage, Liability and Insurance

9.1 Gardeners St. John’s Wood will take reasonable care to avoid damage to property while carrying out the Services. However, minor damage or wear and tear that is reasonably incidental to gardening work, such as slight scuffing on heavily used paths or fences, shall not be considered a breach of this Agreement.

9.2 If you believe we have caused damage to your property, you must notify us as soon as reasonably practicable, and in any event within 7 days of the relevant visit, providing details and any available evidence.

9.3 Our liability for loss or damage arising from our negligence or breach of this Agreement shall be limited to the total price paid or payable by the Client for the Services giving rise to the claim, except where such limitation is prohibited by law.

9.4 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

9.5 We shall not be liable for any indirect or consequential loss, loss of profit, loss of enjoyment, loss of business, or loss of opportunity arising out of or in connection with the Services, to the extent permitted by law.

9.6 Gardeners St. John’s Wood maintains appropriate insurance cover for public liability and, where applicable, for employees, in line with industry practice.

10. Health and Safety

10.1 We take health and safety seriously and operate in accordance with relevant legislation and guidance. Our staff are instructed to work safely and to cease work if they consider conditions to be unsafe.

10.2 The Client must not request or insist that our staff carry out any task that could reasonably be considered unsafe or beyond the scope of the agreed Services.

10.3 Children, pets and other occupants should be kept away from the immediate work area during our visit to reduce the risk of accidents.

11. Complaints and Dispute Resolution

11.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible so that we have an opportunity to address the issue.

11.2 We will investigate complaints in good faith and may, at our sole discretion, offer to rectify any defect in the Services or provide a partial refund where appropriate.

11.3 If a dispute cannot be resolved between us through informal discussion, either party may seek to resolve the matter through mediation or through the courts, as appropriate.

12. Privacy and Data Protection

12.1 We will handle personal information provided by the Client in accordance with applicable data protection laws. We will use personal data for purposes such as managing bookings, providing the Services, and dealing with queries or complaints.

12.2 We will not sell or rent your personal information to third parties. We may share your details with trusted service partners only where necessary for the performance of the Services or where required by law.

13. Amendments to These Terms

13.1 Gardeners St. John’s Wood may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that booking.

13.2 Any changes that materially affect existing ongoing contracts will be communicated to the Client, and continued use of the Services after notification will be taken as acceptance of the revised terms.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Services, or their subject matter.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

15.2 No failure or delay by Gardeners St. John’s Wood in exercising any right, power or remedy under these Terms and Conditions shall operate as a waiver of that right, power or remedy.

15.3 The Agreement is between Gardeners St. John’s Wood and the Client. No other person shall have any rights to enforce any of its terms.

15.4 These Terms and Conditions, together with any quotation, work order or booking confirmation, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.
